Mr. Sandler (Chairman) called the meeting to order at 7:00 PM.
Continued Hearing - Residential Site Plan Approval
CASE PB#2004-14 - RENEE & STUART ROTHMAN, 60 Ober Road Newton, MA. 02459, requests Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV, to add screen porch, sunroom and stairway to an existing dwelling resulting in a Site Coverage Ratio exceeding 0.15 for property located at 14 Gile Road, Eastham, Map 07 Parcel 538.
Clint Kanega (Landscape Contractor) provided an overview of the revised landscape plan submitted for the project. Renee Rothman (Applicant) presented the revised plan for the enclosed porch and roof deck. Peter Fenn (119 Bay Road) expressed concerns that the 2:1 slope indicated on the revised landscape plan is inadequate.
A MOTION was made by Mr. Holland and SECONDED by Ms. Morse to APPROVE - Site Plan Approval-Residential for CASE PB#2004-14 - RENEE & STUART ROTHMAN, 60 Ober Road, Newton, MA 02459, under Eastham Zoning By-Laws Section XIV, to enclose existing deck in accordance with revised plans submitted resulting in Site Coverage Ratio exceeding 0.150 sq. ft. for property located at 14 Gile Road, Eastham, Map 07 Parcel 538 upon the CONDITION: No building permits to be issued for five (5) years from the date of this approval which expands exterior or decks. The Planning Board finds that the issuance of this Residential Site Plan Approval is consistent with the standards and criteria specified in Section XIV (E) of the Zoning By-Laws. THE VOTE: 6-0

Continued Hearing - Residential Site Plan Approval
CASE PB#2004-19 - NANCY L. MACRIS, 724 Olde Point Road, Hampstead, NC 28443, requests Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV, to construct a guest house(1375 sq. ft.), expand an existing structure by adding 650 sq. ft., and replace an existing barn (625 sq. ft.), resulting in Site Coverage greater than 3,000 sq. ft. for property located at 1750 Nauset Road, Eastham, Map 09 Parcel 405.
John Macris (Applicant) submitted a request to reduce requested new Site Coverage to include only 650 square foot addition to existing house. The Chair asked for public comment on this request and there was none.
A MOTION was made by Ms. Morse and SECONDED by Mr. Cole to APPROVE - Site Plan Approval-Residential for CASE PB#2004-19 - NANCY L. MACRIS, 724 Olde Point Road, Hampstead, NC 28443, under Eastham Zoning By-Laws Section XIV, to expand existing dwelling in accordance with reduced request submitted resulting in Site Coverage greater than 3,000 sq. ft. for property located at 1750 Nauset Road, Eastham, Map 09 Parcel 405 upon the CONDITION: Final approval of Board of Health. The Planning Board finds that the issuance of this Residential Site Plan Approval is consistent with the standards and criteria specified in Section XIV (E) of the Zoning By-Laws. THE VOTE: 5-0 (For: Sandler, Cole, Klink, Holland, and Morse)
Mr. McDonald rejoined the Board.
Ms. Morse recused herself from deliberating on Case PB#2004-25
Approval Not Required (ANR) Plan
CASE PB#2004-25 - PAMELA A. NICKERSON, 52 Dyer Prince Road, Eastham, MA 02642, Map 020 Parcel 001.
Phil Scholomiti (Surveyor) provided an overview of the request to divide existing lot into two lots.
A MOTION was made by Mr. Cole, seconded by Mr. McDonald to endorse the ANR plan.
VOTE: Unanimous (4-0): Sandler, Cole, Holland, and McDonald
Ms. Morse rejoined the Board.
New Hearing - Residential Site Plan Approval
CASE PB#2004-22 - ART & REGINA CESTARO, PO BOX 367, NORTH EASTHAM, MA 02651,requests Residential Site Plan Approval under Eastham Zoning Bylaws Section XIV to construct a new structure on existing foundation increasing size by 930 sq. ft. resulting in Site Coverage greater than 3,000 sq. ft. for property located at 586 Massasoit Road, Eastham, Map 08 Parcel 278B.
Art Cestaro (Applicant) presented an over of the proposed project. Edward Bresnahan (15 Starboard Lane) was in attendance in the audience and indicated he did not have any objection to the project.
A MOTION was made by Ms. Morse and SECONDED by Mr. Holland to APPROVE - Site Plan Approval-Residential for CASE PB#2004-22 - ART & REGINA CESTARO, PO Box 367, North Eastham, MA 02651, under Eastham Zoning By-Laws Section XIV, to construct a new dwelling on an existing foundation in accordance with revised plans submitted resulting in Site Coverage greater than 3,000 sq. ft. for property located at 586 Massasoit Road, Eastham, Map 08 Parcel 278-B. The Planning Board finds that the issuance of this Residential Site Plan Approval is consistent with the standards and criteria specified in Section XIV (E) of the Zoning By-Laws. THE VOTE: 6-0 (For: Sandler, Cole, Klink, Holland, McDonald and Morse)
Mr. Cole recused himself from deliberating on Case PB#2004-24
New Hearing - Residential Site Plan Approval
CASE PB#2004-24 - EDWARD T. PATTEN, TRUSTEE, 1 Liberty Sq. 4th Floor, Boston, MA 02109, requests Residential Site Plan Approval under Eastham Zoning Bylaws Section XIV to construction an addition, and dormer increasing size by 980 sq. ft. resulting in Site Coverage greater than 3,000 sq. ft. for property located at 40 Tomahawk Trail, Eastham, Map 25 Parcel 019.
Matt Miller (Architect) and Frank Corbin (Landscape Architect) presented an overview of the plan that was also approved by the Conservation Commission. Peter McDonald reported on the joint site visit with the Conservation Commission. The Chair asked for public comment on this request and there was none.
A MOTION was made by Ms. Morse and SECONDED by Mr. McDonald to APPROVE - Site Plan Approval-Residential for CASE PB#2004-24 - EDWARD T. PATTEN, 1 Liberty Sq. 4th Floor, Boston, MA 02109, under Eastham Zoning By-Laws Section XIV, to construct an addition and dormer increasing size by 980 sq. ft. resulting in Site Coverage greater than 3,000 sq. ft. for property located at 40 Tomahawk Trail, Eastham, Map 25 Parcel 019 upon CONDITIONS: Final approval from the Board of Health and compliance with Conservation Commission’s conditions of approval. The Planning Board finds that the issuance of this Residential Site Plan Approval is consistent with the standards and criteria specified in Section XIV (E) of the Zoning By-Laws. THE VOTE: 5-0 (For: Sandler, Klink, Holland, McDonald and Morse)
Mr. Cole rejoined the Board.
Other Business
Zoning Working Meetings – The Board its next work session for August 31, 2004 @ 7:00 PM in Town Hall.
